By purchasing and using any products from Octa, LLC (“Octa”), you understand and accept that there is a possibility of resulting loss, damage or injury. Please take care to avoid misuse of any products.

Except as expressly provided in the warranty and/or return policy, there shall be no warranties, express or implied, with regard to the products you purchase from Octa, and Octa hereby disclaims any and all express or implied warranties including the implied warranties of merchantability, fitness for a particular purpose and non-infringement of third party rights.

Octa LLC, its affiliates, officers, directors, managers and agents hereby disclaim any and all liability for any loss, damage or injury resulting from the use or misuse of its products. In no event shall Octa be liable for any direct, indirect, punitive, incidental, special consequential damages whatsoever arising out of or connected with the use or misuse of its products, including, without limitation, property damage, loss of value of the product or any third party products that are used in or with the product, or loss of use of the product or any third party products that are used in or with the product, even if Octa is aware of the possibility of such damages.

Octa shall have no liability for any damage or destruction to consumer electronics devices or other personal property that are used with the products, including, without limitation, laptops, tablets, e-readers, cell phones, netbooks or handheld devices, or any loss of data contained in such devices. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract, tort (including negligence) or otherwise), the entire liability of Octa and any of its suppliers shall be limited to the amount actually paid by you for the product.

Your sole and exclusive remedy for a breach of the limited warranty above, and Octa’s sole and entire liability is, at Octa’s option, to repair or replace a product or refund the purchase price of the product within 30 days. This disclaimer statement is governed by the laws of the State of Colorado, USA and by purchasing and using any products by Octa, you hereby consent to the exclusive jurisdiction and venue of the courts of Colorado, USA, in all disputes arising out of or relating to the use of any product. Use of Octa products is prohibited in any jurisdiction that does not give effect to all provisions of these terms and conditions.

Octa provides its website and its contents “AS IS”, and makes no warranty or representation as to its website or the information provided therein. Octa reserves the right to modify and update the terms, conditions, and notices in connection with its website and products.
